4. Acceptable Use and Prohibited Behaviours

What Users Can Do:

  • Customise Profile: Users can edit their profile information, including their profile picture.
  • Access Content: Users can browse and view available content they have entered.
  • Interact with Content: Users can move, delete and share content within the app.
  • Receive Notifications: Users can opt-in to receive notifications about updates, new content, and app features.
  • Connect with Other Users: Users can collaborate their locations with other Dear Memory users.
  • Report Issues: Users can report bugs or issues through the app or website for support.

What Users Cannot Do:

  • Share Personal Information: Users are prohibited from sharing sensitive personal information, such as social security numbers or financial details.
  • Harass Other Users: Any form of harassment, bullying, or abusive behaviour is strictly forbidden.
  • Post Inappropriate Content: Users cannot post or share content that is offensive, obscene, or violates copyright laws.
  • Impersonate Others: Users are not allowed to impersonate other individuals or organisations.
  • Engage in Fraudulent Activities: Any form of fraud, including scams or deceptive practices, is prohibited.
  • Bypass Security Measures: Users cannot attempt to hack, modify, or bypass any app security features.
  • Use Automated Tools: Bots or automated tools to interact with the app are not allowed.

Prohibited Activities:

  • Spamming: Sending unsolicited messages or advertisements is not permitted.
  • Data Mining: Extracting data for commercial purposes without permission is prohibited.
  • Disrupting Service: Actions like denial-of-service attacks are strictly prohibited.

5. Payment Clauses

Free Trial Access:

  • No immediate payment required during sign-up.
  • Credit or debit card details are required during registration.
  • Full access to the app during the trial period.
  • Subscription can be cancelled anytime during the trial without charges.
  • Users will be notified before the first charge.

Automatic Payment After Free Trial:

  • If not cancelled, the selected plan will be charged automatically.
  • Monthly or yearly charges apply based on user selection.

6. Disclaimers and Warranties

Dear Memory is provided "as is" and "as available", without warranties of any kind. We are not liable for:

  • Any direct, indirect, incidental, or consequential damages.
  • Loss of data, revenue, or business.
  • Technical issues or service interruptions.
  • Unauthorized access due to compromised credentials.
  • Viruses or harmful code transmitted through the app.
  • Reliance on app-provided information.

7. Governing Law

These Terms are governed by the laws of Australia. You agree to the exclusive jurisdiction of the courts of Western Australia.

8. Termination of Service

We may suspend or terminate your account if you violate these Terms or engage in prohibited activities.
